Your access to and use of all information on this website including purchase of our product(s) is provided subject to the following terms and conditions and our privacy policy (together, the terms and conditions)

We reserve the right to amend the terms and conditions at any time and your use of the website will represent your agreement to be bound by these terms and conditions and any amendments which will take effect immediately.. We therefore recommend that each time you access our website you read these terms and conditions. If you do not agree to these terms and conditions please do not use our website or our products.

Campaign summary (for convenience only): Post your most creative colour‑change moment with a genuine Frank Green Colour Change product on TikTok or Instagram between 20 October – 30 November 2025 using #PourInTheMagic and tagging @frankgreen_official. One weekly winner will receive a curated Colour Change prize pack valued up to AUD $500 (or local equivalent). Winners announced weekly via @frankgreen_official. The summary doesn’t replace the full terms below.

1. Eligibility

1.1 Open worldwide to natural persons aged 18+ (or the age of majority in their jurisdiction, if higher).
1.2 Employees, officers and contractors of the Promoter, its agencies and immediate family/household members are not eligible.
1.3 Void where prohibited or restricted by law. The contest is not open to residents of jurisdictions under comprehensive trade sanctions or where skill contests of this type are unlawful.
1.4 Social platform accounts must be in good standing and compliant with platform rules.

2. Campaign Period

2.1 Starts 20 October 00:00 AEDT and ends 30 November 23:59 AEDT (the “Campaign Period”).
2.2 Six weekly judging windows (“Weeks”):

• Week 1: 20–26 Oct

• Week 2: 27 Oct–2 Nov

• Week 3: 3–9 Nov

• Week 4: 10–16 Nov

• Week 5: 17–23 Nov

• Week 6: 24–30 Nov

3. How to Enter (No Purchase Necessary)

3.1 Create an original video or photo post featuring a genuine Frank Green Colour Change product (reusable bottles, cups and/or to‑go bowl).
3.2 Post on TikTok or Instagram  during the Campaign Period.
3.3 Include #PourInTheMagic and tag @frankgreen_official (or the handle field/platform tagging method where available).
3.4 Set the post to public for the entire Campaign Period and until winners are confirmed.
3.5 Unlimited entries are allowed, but each must be materially different; do not spam or repost identical content as this will automatically make your content ineligible.

4. Content Requirements

4.1 Entries must be original to the entrant, lawful, safe, and brand‑safe (no nudity, hate, harassment, bullying, dangerous acts, weapons, illegal drugs, or infringement).
4.2 If other people appear, you must have their permission. If minors appear, you must be their parent/legal guardian or have verifiable parental consent.
4.3 Do not include third‑party music, trademarks, or materials without the necessary rights.
4.4 The product should be used safely and per its instructions (the colour change effect is activated by cold).
4.5 The Promoter may, at its absolute discretion, disqualify any entry that violates these terms or community standards.

5. Nature of Promotion (Game of Skill)

5.1 This is a game of skill; chance plays no part in determining winners.
5.2 A judging panel appointed by the Promoter will evaluate entries based on:

• Creativity & Originality  – fresh, imaginative use of the colour‑change moment.

• Clarity of Colour‑Change Reveal – how clearly and impressively the change is shown.

• Execution & Craft  – filming, editing, sound (if any), and overall quality.

• Brand Fit & Safety  – positivity, alignment with frank green values and safe use.
  5.3 While social engagement may be considered as context, it is not decisive.

6. Prizes & Winner Selection

6.1 Weekly Winners (6 total): One winner per Week. Each receives a curated Frank Green Colour Change prize pack valued up to AUD $500 (approximate retail value; local currency equivalent based on prevailing rates). Prize contents are at the Promoter’s absolute discretion and may vary by region/availability.

 6.2 Limit: A person may win a maximum of one Weekly Prize. Weekly winners remain eligible for the Grand Prize.
6.3 Winners will be contacted via DM or as otherwise reasonable.
6.5 Winners must respond within 7 days and may be required to complete eligibility/identity verification and a publicity & rights release. Failure to respond or be verified may result in forfeiture and selection of an alternate.
6.6 Taxes & Duties: Winners are solely responsible for any applicable taxes, customs duties, or fees. The Promoter may issue tax forms as required by law.
6.7 No cash alternative unless required by law. The Promoter may substitute prizes with items of equal or greater value if necessary.

7. License & Publicity

7.1 By posting an entry with the required hashtag(s)/tag(s), you grant the Promoter a perpetual, worldwide, royalty‑free, irrevocable, transferable and sublicensable license to use, reproduce, edit, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your entry (in whole or part), including your name/handle, likeness, voice and biographical details as shown in the entry, in any media now known or later developed, for advertising, marketing, publicity, and promotional purposes, without further notice, approval, or additional compensation, to the fullest extent permitted by law.
7.2 You waive (to the extent permitted) any moral rights you may have in the content.

8. Privacy

8.1 The Promoter will process personal data (e.g., name/handle, contact details, entry content, region) to administer the Contest and for prize fulfilment and publicity, per its Privacy Policy available at frankgreen.com.au/privacy.
8.2 Where required, data may be transferred outside your country of residence subject to appropriate safeguards.
8.3 You may exercise privacy rights as described in the Privacy Policy.

9. Representations, Warranties & Indemnity

9.1 You represent and warrant that your entry is original, does not infringe any third‑party rights, complies with these Terms and applicable laws, and that you have all rights and permissions needed to grant the license in Section 7.
9.2 You agree to indemnify and hold harmless the Promoter from any claims arising from your breach of these Terms or your entry.

10. General Conditions

10.1 The Promoter reserves the right, at its absolute discretion, to verify entries and entrants and to refuse, remove, or disqualify any entry that does not comply.
10.2 If the Contest is compromised by fraud, technical failures, platform outages, or any cause beyond the Promoter’s control, the Promoter may modify, suspend, or cancel the Contest or any prize.
10.3 The Promoter’s decisions (including selection of winners) are final and no correspondence will be entered into.
10.4 The Promoter is not responsible for late, lost, damaged, corrupted, misdirected, or ineligible entries, or for any technical, network, or platform issues.
10.5 To the fullest extent permitted by law, the Promoter and its affiliates are not liable for any indirect, incidental, or consequential damages arising out of participation or prize use. Nothing excludes liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be limited by law.
10.6 If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

11. Platform Disclosure

11.1 This Contest is not sponsored, endorsed, administered by, or associated with TikTok, Instagram, YouTube, or Google. You release those platforms from any claims arising out of or in connection with the Contest. You must comply with each platform’s terms and community guidelines.

12. Governing Law & Disputes

12.1 Except where prohibited by local consumer laws, these Terms are governed by the laws of Victoria, Australia, without regard to conflict‑of‑laws rules, and you submit to the non‑exclusive jurisdiction of its courts.
12.2 Nothing in these Terms deprives you of mandatory consumer rights that cannot be waived.

13. Winners List & Contact

13.1 Weekly winners and the grand prize winner will be announced on @frankgreen_official and may be listed on frankgreen.com.au/colourchange for at least 30 days after the Campaign Period.
13.2 For winner confirmation or questions, contact the Promoter via frankgreen.com.au/contact (include “Pour In The Magic” in the subject).

By participating in the Promotion, each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding.

There will be 4 prize winners. The winners will receive:

The winner/s of this promotion will be notified via Instagram DM to their nominated Instagram account within five business days of the draw. In this message the winner/s will be sent instructions regarding how to redeem their prize. 

Once the prize winners are deemed by the Promoter to have complied with these terms and conditions of entry, the Promoter will deliver the relevant prize within 28 days of the winner/s entry being verified and accepted.

The prize/s must be accepted by 11am 30 October 2025 (AEDT).

The Promoter reserves the right to alter the rules of the competition at any time, subject to regulatory approval. 

GENERAL 
The Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this competition and/or provide an alternative prize.

The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate. Where we become aware of any misdescription, we reserve the right to correct the error or omission.

Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product.

Product orders

Our products are for sale to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age.

We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website.

All prices are in New Zealand Dollars (NZ) and are exclusive of GST. Prices can be accessed on the product pages and we reserve the right to amend our prices at any time.

Unless specifically stated otherwise, shipping is an additional charge. For New Zealand orders shipping will be charged at a flat rate of $25.00.  For international orders, shipping will be calculated based on the destination selected at time of purchase. International orders may be subject to import duties and taxes, which are levied once a shipment reaches it’s destination. Any additional charges including customs clearance are your responsibility.

When you order from us, we require you to provide your name, address for delivery, email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

Once you have submitted an order, you may not cancel that order even if our acceptance or rejection of your offer is still pending.

We undertake to ship your ordered product(s) within 48 hours of your order being received on a normal business day. Title in the goods passes to you when you have signed for the delivery.

Once your order has been shipped we will provide you a link our third party logistics provider to track your parcel.

All risk of loss or damage to the goods passes to you when we dispatch the goods. 

Payments

We process all online payments through PayPal or ANZ eGate. This is transmitted via a GeoTrust Secure Sockets Layer version 3.0 (SSL) certificate which encrypts your credit card data for processing by our third party payment gateway.

All credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to frank green, we will not be liable for any delay or non-delivery.

If we are unable to process your credit card, please check to ensure you entered the details correctly and that the billing name and address match your credit card statement. Please refer to your credit card provider if the problem persists.

Gift Cards

Your frank green gift card can be redeemed (includes product and shipping) to the value of the gift card via the frank green website frankgreen.com.   

You do not have to use the total amount of your gift card in one transaction and can use the balance of the gift card over multiple transactions, within the validity period (within 24 months from date or purchase). To access your available balance, simply log in to your frank green account.

To redeem your gift card, simply select which products you would like to purchase and add to the cart. The gift card can be redeemed on the cart page when making your purchase. Your gift card amount will then be automatically deducted as payment on your order.

When redeeming your gift card, additional items or services may be added. The balance of the transaction must be paid using another payment accepted by the frank green website.

The gift card is valid for a period of 24 months from the purchase date. The frank green gift card will be emailed to the purchaser who can forward it on to the recipient. The frank green smart products purchased with the gift card will arrive once the order has been processed with the gift card and payment has been taken.

Gift cards cannot be discounted, returned or exchanged for cash. All returned items that were paid for with a gift card will be refunded as a store credit for you to use against a future purchase. This store credit will expire 12 months from issue. 

To return an item that has been purchased with a gift card, just head to the FAQ page for further details. If you return an item paid by both gift card and another payment method (ie credit card), you will be refunded up to the amount of your initial credit card payment and the remaining amount will be refunded as store credit.

 

Order cancellation due to error

Where a product has been listed at the incorrect price or with incorrect descriptive information or image due to an error or oversight, we reserve the right to cancel a transaction. We will refund the total amount debited to your nominated bank as soon as practical.

 

Product returns

We're happy to facilitate a return or exchange for new, unused products in original packaging. If you wish to return your frank green product for a refund, you must notify us within 14 days of receiving your order.

To qualify for a return or an exchange, please ensure the item is unopened, undamaged and unused. Kindly note, that Lucky Bag products, monogrammed products and limited edition collections are final sale and are not eligible for return unless faulty or damaged on arrival. In the case of a change of mind return, shipping costs are not reimbursed and frank green is not responsible for returns until they have been delivered to and inspected by our team. Refunds will be offered in the form of store credit or processed to the original method of payment. We reserve the right to refuse your refund if your item does not meet the returns criteria.

If there is an issue with your order upon arrival please contact us via email within 7 days of delivery. Replacement requests must be accompanied by a photo of the item and packaging with your order number/proof of purchase.

Please note, monogrammed items, limited edition collections and Lucky Bags are final sale and are not eligible for change of mind returns unless faulty or damaged.

 

Site access

When you visit our website, we give you a temporary and limited licence to access and use our information for personal use.

Except as permitted under the Copyright Act 1968 (Cth), you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without our prior express written permission of an Authorised Officer of Frank Green.

The licence to access and use the information on our website does not include the right to use any data mining robots or other extraction tools. The licence also does not permit you to metatag or mirror our website without our prior written permission. Statutory guarantees and warranties to consumers

Schedule 2 of the competition and consumer act 2010 (‘c&c act’) defines a consumer. under the c&c act we are a supplier of either goods or services or both to you. if you meet the definition of a consumer under the c&c act gives you certain rights including:

Indemnity

By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses (including consequential loss) including legal fees arising from or in connection with your use of our website.

Force Majeure

If a Force Majeure event causing delay, we may terminate this Agreement by giving at least 7 days Notice to you. ‘Force Majeure’ means any act, circumstance or omission over which we could not reasonably have exercised control.

Jurisdiction

These terms and conditions are to be governed by and construed in accordance with the laws of Victoria, Australia and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Victoria and you agree to submit to the jurisdiction of those Courts.

If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Privacy

We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
